MEREDITH, District Judge. This is an appeal by Darrell E. Copenhaver, appellant, in forma pauperis from a final order of the district court filed December 23, 1964, denying his petition for a writ of habeas corpus without a hearing. Appellant's primary contention before this Court is that the district court erred in not holding a ""full evidentiary hearing"", in contravention of the basic rules as to postconviction relief set out in the landmark triology of postconviction cases: Townsend v. Sain, 372 U.S. 293, 83 S. Ct. 745, 9 L. Ed. 2d 770 (1963); Fay v. Noia, 372 U.S. 391, 83 S. Ct. 822, 9 L. Ed. 2d 837 (1963); Sanders v. United States, 373 U.S. 1, 83 S. Ct. 1068, 10 L. Ed. 2d 148 (1963).
